WARDELL LAW FIRM

Justice Lab

What is the Justice Lab?

Wardell Law Firm is one of a very few law firms in the state of Florida that has their own on-site mock courtroom located at our Tampa offices.  We built this courtroom because the only way to get full and fair justice for our clients is to try cases.  Before trying a case, we want to see what actual jurors think about all of the issues in the case before we actually try it.  We want to let our clients get the feel of testifying in a real courtroom atmosphere so when the time comes, they are comfortable and have a good idea of what to expect during a real trial.

We call it the Wardell Law Firm - Justice Lab, because we test and experiment until we are sure we have the best formula for maximum justice for our clients.  Even if a case settles for full value, it will usually only do so right before trial.  Insurance companies know the lawyers and law firms that will take cases to trial if they don’t pay the full amount we demand.  We have earned that reputation throughout our over 30 years’ experience practicing law.  We also give feedback to the insurance companies based on what jurors in the Justice Lab study thought about a particular case or issue.

Benefits of the Justice Lab to your unique case:

  • Test theories of your cases.

  • Figure out why jurors feel the way they do about an issue.

  • Frame your case.

  • Sequence how to present your case.

  • Develop the story of your case and test jurors’ reaction to it.

  • Determine whether jurors feel witnesses are credible.

  • Test your exhibits to make sure the point you are trying to convey is getting across.

  • Explore areas of bias among people to see how they might affect their decisions.

  • Practice testifying to make clients feel comfortable and confident about their testimony at trial or in deposition.

  • Test potential juror attitudes about things such as damages or comparative faults.

  • Figure out if certain types of people are better suited for your particular case.

  • Play actual video testimony or read deposition transcripts to test juror reactions to the testimony you expect at trial

  • Help get a sense for asking for enough money in the case compared to how the jurors will measure the damages suffered.

The Tampa Bay Buccaneers, Rays, or Lightning wouldn’t take the field or ice without practicing first. Trying a case as important as yours is no different.

Justice Lab Criminal Case Benefits:

  • Prepare your client to testify and do a practice cross-examination like they will face from a prosecutor

  • Test conduct of law enforcement to see if it undermines credibility

  • Find what reasonable doubts are sufficient for the jurors to be comfortable returning a not guilty verdict

  • Gauge sympathy towards any victim of a crime

  • Test self-defense theories

  • Test alibi’s

  • Test circumstantial evidence and the weight it will be subscribed.  ( The best real life example of this is a recent murder case our firm tried. There was DNA on a glove found near the murder scene in a remote area that matched my clients.  After 3 or 4 separate focus groups, I was confident that the DNA evidence on the glove was not given the weight by jurors we thought it would.  They felt the evidence was not that strong because he could have worn the glove before the incident. The glove also had other people’s DNA on it that could not be identified.

The vehicle that transported the suspects to the murder scene was a vehicle our client had driven in previously to construction sites for work.  Finally, the DNA could not be aged meaning no one could say when it got on the glove. We were able to use this as an example because the prosecutor thought this was his powerful piece of evidence.  We made sure to highlight this in our examinations of the DNA expert and law enforcement all of the points the jurors told us mattered to them. Once we showed why our clients DNA on the glove does not exclude reasonable doubts, we knew the prosecutor was focused on the wrong issue.
